These Terms of Service govern use of www.kairaliproducts.com and purchases made through it. The seller and website operator is Kairali Ayurvedic Products Private Limited (“Kairali”, “we”, “us” or “our”), a company registered in India under CIN U85191DL2007PTC167500.
1. Eligibility and accounts
You must have legal capacity to enter a contract in your jurisdiction and provide accurate, current information. You are responsible for safeguarding account credentials and notifying us promptly of suspected unauthorised access. We will never ask for your password, card PIN, CVV, bank password or OTP.
2. Country and product eligibility
A destination appearing in checkout does not mean every product may legally or practically be sold, imported or used there. Eligibility can depend on ingredients, classification, labelling, quantity, claims, local registration, the intended user and destination rules. We may restrict or cancel an affected item or order when sale, export, import or delivery cannot be completed lawfully or safely. If we cancel after receiving payment, we will initiate the applicable refund.
3. Product information and health
Read the product page, destination-appropriate label, ingredients, directions, warnings and expiry information before purchase and use. Product information is general information and does not replace individual medical diagnosis, treatment or emergency advice. Consult an appropriately qualified professional where a health condition, pregnancy, breastfeeding, allergy, medicine interaction or use for a child makes this appropriate.
4. Orders and acceptance
Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or dispatch, subject to payment authorisation, stock, address verification, destination/product eligibility and applicable law. We may reject or cancel an order for an evident pricing or description error, suspected fraud, unavailable stock, delivery restrictions, legal or safety concerns, or an inability to fulfil it.
5. Prices, currency, taxes and payment
The currency, product price, shipping charge, taxes and total shown in checkout before payment form the transaction total, subject to correction of an evident error before acceptance. Your bank or payment provider may apply conversion or cross-border charges not controlled by us. Import duties, taxes, brokerage or permit costs are handled as described in the Shipping & Delivery Policy. Payment providers process payment credentials under their own terms; Kairali remains responsible for its obligations as seller.
6. Shipping, cancellation, returns and refunds
Delivery scope, estimates, charges, customs responsibilities and exceptions are set out in our Shipping & Delivery Policy. Cancellation, withdrawal, return, replacement and refund eligibility are set out in our Return & Refund Policy. Those policies form part of these Terms. Mandatory consumer rights applicable to the customer or transaction prevail where they provide greater protection.
7. Promotions
A promotion or discount applies only for its stated period, products, destinations, customers and conditions. Unless expressly allowed, offers cannot be combined, transferred, redeemed for cash or applied retrospectively. We may cancel misuse or an order affected by a genuine technical or pricing error, while respecting applicable consumer law.
8. Acceptable use
You must not use the website to break the law; infringe another person's rights; submit malicious code; interfere with security or operation; scrape or access the service through unauthorised automated means; impersonate another person; make fraudulent purchases; evade destination controls; or submit unlawful, deceptive, abusive or defamatory material.
9. Intellectual property and customer content
The website and its original text, graphics, photographs, designs, trade marks and software are owned by or licensed to Kairali and protected by applicable law. You may use the website for personal, lawful shopping and information purposes. If you submit a review or other content, you confirm that it is truthful, lawful, based on your experience and does not violate another person's rights. We may moderate content where permitted by law.
10. Third-party services
The website may use or link to payment, delivery, customs, analytics, social-media and other third-party services. Their separate terms and privacy notices may apply to their services. A link does not by itself constitute an endorsement. We remain responsible for obligations that the law places on us as seller.
11. Availability, warranties and liability
We take reasonable steps to keep the website and information available and accurate, but maintenance, network failures, customs action, carrier interruption or events outside reasonable control may cause delay or interruption. To the maximum extent permitted by law, liability is limited to losses that are a reasonably foreseeable result of our breach. Nothing in these Terms excludes liability or a remedy that cannot lawfully be excluded.
12. Privacy
Our Privacy Policy explains how personal data is handled. Do not submit unnecessary health, identity or payment information through general contact channels. Privacy rights may vary by location.
13. Changes and severability
We may update these Terms prospectively. The version presented when an order is placed governs that order unless law requires otherwise. If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer law, forum or jurisdiction available to the customer, courts in Delhi, India have jurisdiction. This clause does not remove protections that cannot lawfully be waived in the customer's jurisdiction.
